{"id":1693,"date":"2018-01-25T17:12:27","date_gmt":"2018-01-25T17:12:27","guid":{"rendered":"https:\/\/kirtlingandupend.org\/wp\/?page_id=1693"},"modified":"2018-03-01T16:24:14","modified_gmt":"2018-03-01T16:24:14","slug":"community-right-to-bid-moratorium-notice-the-red-lion-kirtling","status":"publish","type":"page","link":"https:\/\/kirtlingandupend.co.uk\/?page_id=1693","title":{"rendered":"Community Right to Bid Moratorium Notice &#8211; The Red Lion, Kirtling"},"content":{"rendered":"<p lang=\"en-GB\" align=\"center\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>Community Right to Bid Moratorium Notice<\/b><\/span><\/span><\/span><\/span><\/p>\n<p lang=\"en-GB\" align=\"center\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>The Red Lion, Kirtling<\/b><\/span><\/span><\/span><\/span><\/p>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>The Red Lion Public House <\/b><\/span><span style=\"font-size: small;\">is designated an Asset of Community Value, under the Localism Act 2011, following a successful nomination from Kirtling and Upend Parish Council. <\/span><\/span><\/span><\/span><\/p>\n<p lang=\"en-GB\"><a name=\"_GoBack\"><\/a> <span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>In accordance with the requirements of Section 95 of the Localism Act 2011, East Cambs District Council received notification from the current owner that the above assets are to be disposed of through a freehold sale. This notification was received on 16<\/b><\/span><sup><span style=\"font-size: small;\"><b>th<\/b><\/span><\/sup><span style=\"font-size: small;\"><b> January 2018. <\/b><\/span><\/span><\/span><\/span><\/p>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">This has set in place the following moratorium timescales on the sale of the asset: <\/span><\/span><\/span><\/span><\/p>\n<table width=\"669\" cellspacing=\"0\" cellpadding=\"7\">\n<colgroup>\n<col width=\"134\" \/>\n<col width=\"128\" \/>\n<col width=\"363\" \/> <\/colgroup>\n<tbody>\n<tr valign=\"top\">\n<td width=\"134\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>Moratorium <\/b><\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<td width=\"128\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>End Dates <\/b><\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<td width=\"363\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>Description <\/b><\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<\/tr>\n<tr valign=\"top\">\n<td width=\"134\" height=\"32\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">Interim Moratorium (6 weeks) <\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<td width=\"128\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>27<\/b><\/span><sup><span style=\"font-size: small;\"><b>th<\/b><\/span><\/sup><span style=\"font-size: small;\"><b> Feb 2018 <\/b><\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<td width=\"363\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">During this period a valid community group may request in writing to the District Council, to be treated as a potential bidder to purchase the above asset. <\/span><\/span><\/span><\/span><\/p>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">If no written request is received prior to the end of the Interim Moratorium as shown, the owner is free to sell the asset on the open market.<\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<\/tr>\n<tr valign=\"top\">\n<td width=\"134\" height=\"55\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">Full Moratorium (6 months from notification of sale) <\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<td width=\"128\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>27<\/b><\/span><sup><span style=\"font-size: small;\"><b>th<\/b><\/span><\/sup><span style=\"font-size: small;\"><b> August 2018 <\/b><\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<td width=\"363\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">If<\/span><b> <\/b><span style=\"font-size: small;\">a written request to be treated as a potential bidder is received from a valid community group within the interim period (as above), the full moratorium period of 6 months will be enforced. The asset owner will not be permitted to sell the asset, unless to a valid community group or through an exempt form of disposal, during this 6 month period. <\/span><\/span><\/span><\/span><\/p>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">After this moratorium period the owner is free to sell the asset on the open market.<\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<\/tr>\n<tr valign=\"top\">\n<td width=\"134\" height=\"31\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">Protection Period <\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<td width=\"128\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\"><b>27<\/b><\/span><sup><span style=\"font-size: small;\"><b>th<\/b><\/span><\/sup><span style=\"font-size: small;\"><b> August 2018 <\/b><\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<td width=\"363\">\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">Following the moratorium period above (whether 6 weeks, or the full 6 months), no further moratorium will be enforced on the sale of the asset for an 18 month protection period (from the date of notification). Therefore if the asset has remained unsold by the date shown, a second moratorium period will be enforced. <\/span><\/span><\/span><\/span><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">Valid community groups that can write to express an interest in being a potential bidder for the asset are: <\/span><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">a Parish Council in whose area the asset lies or, <\/span><\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">any incorporated community group which meets these definitions: <\/span><\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">It has a local connection, meaning that its activities partly or wholly occur in the local area <\/span><\/span><\/span><\/span><\/p>\n<\/li>\n<li>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">It is a charity, a company limited by guarantee, a Community Interest Company or an Industrial and Provident Society or Community Benefit Society. <\/span><\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p lang=\"en-GB\"><span style=\"color: #000000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: medium;\"><span style=\"font-size: small;\">If you would like to be treated as a potential bidder for the asset named above, and use the Community Right to Bid, please write to: <\/span><span style=\"font-size: small;\"><b>Communities and Partnerships<\/b><\/span><span style=\"font-size: small;\"><b>, East Cambridgeshire District Council, The Grange, Nutholt Lane, Ely, Cambs, CB7 4EE<\/b><\/span> <span style=\"font-size: small;\"><b>or acv@eastcambs.gov.uk by 27<\/b><\/span><sup><span style=\"font-size: small;\"><b>th<\/b><\/span><\/sup><span style=\"font-size: small;\"><b> February 2018.<\/b><\/span><\/span><\/span><\/span><\/p>\n<p class=\"western\" lang=\"en-GB\"><span style=\"font-size: small;\"><i><b>Please note: <\/b><\/i><\/span><span style=\"font-size: small;\"><i>Any written request to be treated as a potential bidder cannot be treated as confidential and may be made publicly available at the Council\u2019s offices and on the website.
